General Terms & Conditions

1. Scope

1.1. The following General Terms and Conditions ("GTC") apply to all contracts concluded between DermaPerfect GmbH, Am Sonnenrain 9a, 79539 Lörrach, Germany ("DermaPerfect") and consumers via the website www.derma-perfect.de ("Website").

A consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business, or profession. In the following, the person acting as a consumer shall be referred to as the "Customer".

1.2. The GTC can be viewed at any time on the DermaPerfect website and will also be sent to the Customer again by e-mail in the event of the conclusion of a contract. Deviating, conflicting, or supplementary terms and conditions shall not become part of the contract. Any reference by the Customer to their own general terms and conditions is expressly rejected. DermaPerfect reserves the right to amend these GTC at any time.

1.3. By placing an order, the Customer accepts these GTC. The Customer further declares that they are at least eighteen (18) years old and that the ordered products are purchased for personal use.

2. Conclusion of the Contract

2.1. The ordering process begins by clicking on the link labeled "Shopping Cart". After entering the data required to process the contract (please see our Privacy Policy), as well as selecting the desired payment method and, if applicable, the shipping method, you submit a binding contractual offer by clicking on the button labeled "Order now with obligation to pay". Before submitting the order, you will be shown a summary page displaying the contents of your order to check for possible input errors. You may correct such errors by using the "Back" function of your browser.

2.2. Immediately after submitting your offer, you will receive an automatically generated e-mail confirming receipt of your offer on our server (acknowledgment of receipt). This e-mail does not constitute acceptance of your contractual offer but merely informs you of the receipt of your order. The presentation of the products in the online shop does not constitute a legally binding offer, but merely an invitation to place an order. A purchase contract is only concluded when the ordered goods are dispatched to you, unless DermaPerfect expressly accepts the offer at an earlier point in time.

2.3. Product reviews displayed on our website come exclusively from verified buyers. We ensure the authenticity of the reviews by allowing only customers who have demonstrably purchased the respective product from us or an authorized dealer to submit a review. The review function is automatically activated by e-mail after dispatch of the goods and is linked to the respective order. In the event of price reductions, the lowest price within the last 30 days prior to the price reduction will be indicated as the reference price.

3. Price, Shipping, Payment, Default

3.1. Prices are final prices including VAT and correspond to those displayed on the website at the time of placing the order.

3.2. In case of shipping, additional shipping costs may apply. Details on shipping costs can be found in the .

3.3. The following payment methods are accepted: cards (Visa, Maestro, MasterCard, AMEX), PayPal, Klarna, SEPA, and bank transfer.

3.4. Delivery of ordered products will be made as soon as possible (usually within 1–3 business days), but no later than 14 days after the day DermaPerfect accepts the order.

3.5. With the update of the website or price list, earlier price information becomes invalid.

3.6. Offsetting with unacknowledged or non-legally established counterclaims by the Customer is excluded.

3.7. If the collection of receivables after Customer default is handed over to a debt collection agency, the Customer shall be obliged to bear the incurred and reasonable costs of such action. DermaPerfect reserves the right to claim further damages.

4. Monthly Subscription

4.1. Customers may participate in DermaPerfect’s subscription program, through which they receive the selected products on a monthly basis. The subscription automatically renews each month unless canceled. The initial minimum term is one month.

4.2. Customers may change the products included in the subscription at any time via their customer account or customer support, provided the products are available. Changes must be communicated at least 3 days before the next scheduled shipping date in order to be considered for the upcoming delivery. Later changes will only be applied to the subsequent delivery.

4.3. The subscription may be canceled at any time without notice. Cancellation can be made via the customer account, by e-mail to info@derma-perfect.com , or via the cancellation button provided on the website. In accordance with § 312k BGB, the cancellation button is clearly visible, permanently accessible, and labeled with the words "Cancel subscription" or an equivalent clear wording. After clicking the button, you will be redirected to a confirmation page where you must provide information about the contract to be canceled, your identity, and clear identification of the contract. Cancellation will be confirmed electronically without delay.

4.4. By agreeing to these GTC, the Customer authorizes DermaPerfect to automatically charge the specified payment methods (e.g. credit card or PayPal account). The charge includes subscription orders, shipping costs, and VAT and will be made up to two days before the scheduled shipping date. DermaPerfect may terminate the contract without notice if difficulties in processing payment occur.

4.5. The authorization to charge payment methods remains valid until the Customer cancels the subscription.

5. Right of Withdrawal

5.1. If you are a consumer (i.e., a natural person who places the order for purposes outside their trade or professional activity), you have a statutory right of withdrawal.

5.2. If you exercise your right of withdrawal under this clause, you shall bear the regular costs of return shipment.

5.3. Otherwise, the following provisions of the Withdrawal Policy apply:

Withdrawal Policy

You have the right to withdraw from this contract within fourteen days without giving any reason.

The withdrawal period is fourteen days from the day on which you or a third party designated by you, who is not the carrier, has taken possession of the goods. In the case of a contract for several goods ordered in one order and delivered separately: from the day on which you or a third party designated by you, who is not the carrier, has taken possession of the last good.

by means of a clear declaration (e.g., a letter sent by post or e-mail) of your decision to withdraw from the contract. You may use the model withdrawal form available on our website, but this is not mandatory. You may also complete and submit the model withdrawal form or any other clear declaration electronically on our website . If you use this option, we will immediately (e.g., by e-mail) confirm receipt of such a withdrawal.

To meet the withdrawal deadline, it is sufficient for you to send your communication concerning the exercise of the right of withdrawal before the withdrawal period has expired.

Consequences of Withdrawal

If you withdraw from this contract, we shall reimburse you for all payments received from you, including delivery costs (except for the additional costs resulting from your choice of a type of delivery other than the least expensive standard delivery offered by us), without undue delay and at the latest within fourteen days from the day on which we receive notification of your withdrawal.

We will carry out the reimbursement using the same means of payment as you used for the original transaction, unless expressly agreed otherwise with you; in no event will you incur any fees as a result of the reimbursement.

We may withhold reimbursement until we have received the goods back or until you have supplied evidence of having sent back the goods, whichever is earlier.

without undue delay and in any event no later than fourteen days from the day on which you informed us of your withdrawal from this contract. The deadline is met if you send back the goods before the period of fourteen days has expired.

You will bear the direct costs of returning the goods.

You are only liable for any diminished value of the goods resulting from handling other than what is necessary to establish the nature, characteristics, and functioning of the goods.

6. Retention of Title

6.1. Until full payment is made, the goods remain the property of DermaPerfect.

7. Warranty for Defects and Limitation of Liability

7.1. DermaPerfect is liable for material defects in accordance with the applicable statutory provisions, in particular §§ 434 et seq. BGB.

7.2. We are not liable for damages caused by slight negligence, unless such damages result from the breach of essential contractual obligations ("cardinal obligations"), the fulfillment of which enables the proper execution of the contract and on which you as a contractual partner regularly rely. In the event of a breach of cardinal obligations, our liability for slight negligence shall be limited to the typically foreseeable damage associated with the contract.

8. Special Provisions for Cosmetic Products

8.1. All cosmetic products distributed by DermaPerfect comply with the requirements of Regulation (EC) No. 1223/2009 on cosmetic products.

8.2. Product information, in particular the details of ingredients (INCI), minimum shelf life, and instructions for use, can be found in the respective product description on our website and on the product packaging.

8.3. In case of intolerances or allergic reactions, please discontinue use immediately and consult a doctor if necessary.

9. Copyright

The copyrights of images and texts are held by DermaPerfect or have been licensed to DermaPerfect. Use without express permission is not permitted.

10. Satisfaction Guarantee / Complaints

10.1. In addition to the statutory right of withdrawal, DermaPerfect grants all customers a 30-day satisfaction guarantee from the date of invoice, during which they may return the products for a full refund of the purchase price. To do so, you must send an e-mail to info@derma-perfect.com and return the goods within this 30-day period.

10.2. Shipping and return costs within the scope of the satisfaction guarantee are generally borne by the Customer. Goods returned carriage forward will be fully charged to the Customer.

11. Dispute Resolution

The European Commission provides an online dispute resolution platform (ODR), available at: http://ec.europa.eu/consumers/odr

We are neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.

12. Applicable Law & Jurisdiction

12.1. The contractual relationship between DermaPerfect and the Customer shall be governed by the laws of the Federal Republic of Germany. The choice of law does not affect mandatory consumer protection provisions of the country in which the Customer has their habitual residence. The application of the UN Convention on Contracts for the International Sale of Goods (CISG) is excluded.

12.2. The place of jurisdiction for all disputes arising from the contractual relationship between the Customer and DermaPerfect is the registered office of DermaPerfect, provided that the Customer is a merchant, a legal entity under public law, or a special fund under public law.

13. Severability Clause

Should any provision of these GTC be invalid, the validity of the remaining provisions shall remain unaffected.

14. Data Protection

The Customer’s personal data shall be processed in accordance with the provisions of the EU General Data Protection Regulation (GDPR) and the applicable national data protection laws.
